This Privacy Policy covers the website www.dinnerbroker.com (the “ Site”), which is owned by Pricing Dynamics, Inc., dba DinnerBroker (“DinnerBroker”, “we” or ”us”). DinnerBroker will maintain your data as described in this Privacy Policy.
Your privacy is important to us. To demonstrate our commitment to our users’ privacy, we have agreed to disclose our information practices.
This Privacy Policy is an integral part of our Site and cannot, in any way, be separated from the Users Agreement or from the usage or transaction process. If you do not agree to our Privacy Policy in whole, you must not use the Site. In summary:
- We will not collect personal information without your knowledge and permission;
- We will not knowingly disclose your personal information to third parties, except as provided in this Privacy Policy;
- We will allow you to view, correct or remove your personal information; and
- We will take reasonable steps to protect the security of the personal information we collect from you.
Consent
BY SUBMITTING PERSONAL INFORMATION TO US, AND/OR BY USING OUR SITE, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW.
If you do not agree with these terms, do not provide any personal information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required personal information, we may not be able to provide you with services that can be offered on our Site.
Minors
Minors (as defined under the laws of their jurisdiction or residence) are not eligible to register for, use, or purchase the products or services available on our Site. We do not knowingly collect personal information from any Minor, and will not use this information if we discover that it has been provided by a Minor.
Information that Users Provide to DinnerBroker
User Registration
When you become a dinnerbroker.com user you provide your name, telephone number and email address, a unique login name, password, and password validation. This information is collected on the registration form for several reasons including: (1) personal identification; (2) restaurant reservations; and (3) to allow us to contact you for customer service, if necessary. In addition, your email address is collected to send you an email message confirming your new user registration and each reservation you transact online. As a member, you can sign up to receive updates from us about special offers, new dinnerbroker.com services, and other noteworthy news items. However, you may always choose to decline to receive these email messages at any time. Please see our Opt-out policy described below.
User Profile
Users can choose to provide dinnerbroker.com with restaurant preferences, credit card billing information, and other personal information. This information is primarily used to assist members in making reservations quickly and to provide you with customized offers.
Reservations
If you are not a dinnerbroker.com member already when you book a reservation through our site, we ask you to provide personally identifiable information by filling out and submitting an online customer profile form. This information includes your name, telephone number and email address, and, for certain types of reservations, your credit card number and expiration date. We use this information to process and book your reservation and to notify you of your reservation status by email or fax. When you return to the site and login, we use your account information to provide you with access to your reservation history and allow you to cancel reservations online.
How We Use Your Information
Reservation Information
There are two ways that you can make a reservation on the Site:
As an Unregistered User, you provide only your name, telephone number and email. This information is collected on the reservation form for several reasons including:
- to provide the restaurant with your name so that you may present yourself upon arrival for your reservation,
- to allow the restaurant to contact you via phone if their policy is to confirm via phone,
- to provide DinnerBroker with an email and phone number in case we need to contact you for customer service purposes associated directly with the reservation,
- to automatically send you a confirmation of the reservation via email,
- to automatically send you a cancellation notification via email in the event that you or the restaurant cancels your reservation
- to automatically send you a reminder of your reservation if your reservation was made more than 72 hours prior to the reservation time, and
- to automatically send you an email thanking you for your reservation and inquiring if you experienced any customer service issues.
As a Registered User, you provide the same information as provided by Unregistered Users for the reasons stated above. In addition, you establish an account by providing a password and confirming the password. Registered Users then receive an email message confirming their status as a Registered User. Registered Users may be eligible to complete a User Profile (My Profile), to participate in the DinnerBroker Points Program, and to view their transaction history in the My Transactions section of the Site.
User Profile
Registered Users can choose to provide DinnerBroker with restaurant preferences and other personal information in the My Profile section of the Site. This information is primarily used to assist you in making reservations quickly and to provide you with customized offers.
Credit Card Information
In certain situations, Registered Users must also provide their credit card information in order to use certain functions on the Site including the purchase of Gift Certificates. In these situations, DinnerBroker works with Verisign® to verify the credit card. All such transactions are processed through a fully encrypted e-commerce site that is protected by Verisign®.
Newletters, Discount Alerts and Other Opt-in Emails and Text Messages
You may elect to receive updates from us about special offers, new DinnerBroker services, and other noteworthy news items. However, you must opt-in to these emails and text messages, and you may always choose to decline to receive these email messages and text messages at any time. Please see our Opt-out policy described below. We will never sell, rent or share your personal informaiton, including your email or phone number with and third parties for marketing purposes without your express permission. We may share your personal information with our service delivery providers for the purpose of delivering our email and text messages to your or as required by law.
Choice/Opt-out
Our users are given the opportunity to opt-out of emails and text messges to which they have previously opted-in. This does not apply to emails that are automatically generated by the system (reservation confirmation emails, reservation reminder emails, reservation cancellation emails, reservation thank you emails, registration welcome emails and gift certificate confirmations).
Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by typing unsubscribe in the subject line in a return email or by sending us an email at support@dinnerbroker.com. For emails, we also offer an opt-out mechanism for Registered Users on the User Profile page (My Profile).
Users of our Site are always notified when their information is being collected by any outside parties. We do this so you can make an informed choice as to whether or not you should proceed with services that require an outside party.
Sharing Information
Legal Disclaimer
Although we make every effort to preserve your privacy, DinnerBroker may be required by law to disclose information you have provided in obtaining our services. DinnerBroker may also disclose information against someone who poses a threat to DinnerBroker's interests (such as customer fraud) or whose activities could bring harm to others.
Aggregate Information (non-personally identifiable)
We share aggregated demographic information with our partners. This is not linked to any personally identifiable information.
Third Party Intermediaries
We use an external credit card processing company and bank check processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.
Restaurants
When a reservation is made, restaurants are provided with the guest name you specify and the guest phone number you specify. In addition, if the user has requested that the restaurant send them promotional emails, the restaurant is provided with an email address. You will be given the option to opt-in to these emails during the reservation process. You also have the option of providing the restaurant with special preferences or comments regarding your reservation which DinnerBroker will pass on to the restaurant.
When a gift certificate is purchased, restaurants are provided with the name and phone number of the gift certificate recipient and the name of the purchaser.
Although DinnerBroker offers reservations from reputable restaurants, we have not placed limitations on these restaurants from using or disclosing your information without your permission. Therefore, we encourage you to review the information privacy practices of any restaurants whose reservations you reserve on the Site. In addition, these restaurants may also contact you as necessary to obtain additional information about your confirmed reservation.

Please be aware that we may have links to other websites on our Site that may collect personally identifiable information about you. This Privacy Policy does not cover the information practices or policies of such websites. DinnerBroker does not share the personal information we obtain from you with third parties at these websites.
Usage of Your Information to Enhance the Users Experience
Cookies
Cookies are small pieces of information stored on your computer with information about your visit to a particular site. We use both session ID cookies and persistent cookies. Session ID cookies are erased when you close your browser and do not last beyond one visit to our Site. Session cookies help us keep track of information such as what date or restaurant you are searching for. A persistent cookie is a small file stored on your hard drive for an extended period of time. These cookies are used to remember items like your login information if you have selected for it to be remembered on your computer.
Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. If you reject the cookie, you may not be able to fully use the Site. In particular, session ID cookies are required to store relevant information as a user moves from page to page. Persistent cookies enable us to track and target the interests of our users to enhance the experience on our Site.
Log Files
Like most standard website servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track general user movement (as a whole rather than as individuals), diagnose problems with our servers and gather broad demographic information. IP addresses and log files are not linked to personally identifiable information.
Pixel tags
We use pixel tags to monitor the open rate of our communications. This helps us understand the effectiveness of communications we send. We do not use this information for any other purpose.
Security
DinnerBroker takes every precaution to protect your personal information. When you submit sensitive information via the Site, this information is protected both online and offline. When our reservation order form asks you to enter sensitive information (such as credit card number), that information is encrypted and is protected with state-of-the-art software (SSL). While on a secure page, such as our gift certificate order form, the lock icon on the bottom of web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when Users are just surfing.
While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect your personal information offline. All of our user's information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. Furthermore, all employees are kept up-to-date on our security and privacy practices. Every time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our user's information is protected. Finally, the servers that store personally identifiable information are in a secure environment, in a locked facility.
Correcting/Updating/Deleting/Deactivating Personal Information
If a Registered User’s personally identifiable information (such as zip code, phone, email or postal address) changes or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate user's personally identifiable information. Registered Users can change your personal information on the User Profile (My Profile) page of our Site. Users can also email our customer support at support@dinnerbroker.com or by contact us by telephone or postal mail at the contact information listed below.
Notification of Changes
If we decide to change our policies, we will add those changes to this Privacy Policy and other places on the Site we deem appropriate so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the Privacy Policy under which the information was collected.
If, however, we are going to use your personally information in a manner different from that stated at the time of collection, we will notify you via email. Users will have a choice as to whether or not we use their information in this different manner. However, if you have opted out of all communication with the Site, or deleted/deactivated your account, then you will not be contacted, nor will your personal information be used in this new manner.
California Privacy Rights
Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (1) a list of the categories of personal information, such as name, address, e-mail address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties' direct marketing purposes, and (2) the names and addresses of all such third parties. We will respond to such written requests within 30 days following receipt at the e-mail or mailing address stated above. If we receive your request at a different e-mail or mailing address, we will respond within a reasonable period of time, but not to exceed 150 days from the date received. Please note that we are only required to respond to each customer once per calendar year.
